Creighton has opted into Nebraska’s name, image and likeness (NIL) law, which allows student-athletes in the state to be compensated for use of their name, image, & likeness and subjects the University to the provisions of the Nebraska NIL law.

GENERAL
Creighton University supports student-athletes receiving compensation for the use of their name, image and likeness outside of official team activities in accordance with the guidelines below.
Please note that Creighton’s NIL policy is a working policy in a rapidly evolving area and as such will be subject to ongoing review and revision as circumstances, laws and regulations change. Changes will be communicated through the Creighton Athletics Compliance Office. The application of this policy in no way creates an employment relationship between Creighton University and any student-athlete.
NIL DISCLOSURE REQUIREMENTS - NEBRASKA LAW: As required by LB1393, “any student-athlete who enters into a contract that provides compensation for the use of such student-athlete’s name, image or likeness rights or athletic reputation shall disclose such contract to an official of the post secondary institution for which such student-athlete participates in an intercollegiate sport. The official to which such contract shall be disclosed shall be designated by each post secondary institution, and the designation shall be communicated in writing to each student-athlete participating in an intercollegiate sport.”
CREIGHTON’S DISCLOSURE EXPECTATIONS FOR STUDENT-ATHLETES: All student-athletes are expected to disclose their NIL activity to remain in compliance with State law. Disclosure is expected as each deal is finalized, but no later than 30 days after the NIL agreement is signed. If a student-athlete is found to have engaged in NIL activity without meeting disclosure expectations, he or she will have access to institutional NIL support terminated for a period of time that is scaled to the level of the offense and determined by the designated NIL administrator.
NCAA DISCLOSURE REQUIREMENTS: NCAA rules do not require a student-athlete to disclose NIL activity, but if they do, there are required elements that must be included in the disclosure. Those elements are 1) Name, contact information and relationships for all involved in the NIL activity, 2) terms of the NIL arrangement (payment form, amount, service provided, etc.), 3) names and contact information for any involved professional service providers and 4) terms of compensation between SA and the service provider(s).
Disclosure is required in order to take advantage of assistance from Creighton with NIL. Students disclosing NIL activities through the established process are attesting to the following as part of the disclosure 1) the disclosed information is complete and accurate; 2) the NIL activities are compliance with NCAA rules, CU policy and state law; 3) the disclosed activity does not constitute pay for play and was not provided as an enrollment inducement and 4) the disclosing student is aware that submission of fraudulent information in a disclosure can trigger an unethical conduct charge.

Student-athletes may use Creighton terms (“Creighton,” “Creighton University,” “Creighton University Bluejays,” “Bluejays,” “Jays”) in NIL activities and in promoting/advertising NIL activities.
CREIGHTON FACILITIES
Use of Creighton campus facilities for student-athlete NIL activities shall be considered on a case-by-case basis. Prior approval is required before any action is taken.
UNIVERSITY MARKS, LOGOS, PHOTOS & VIDEOS
Student-athletes are generally not permitted to incorporate Creighton’s marks, logos, content, etc. into their NIL activities. An exception is available for NIL activity that involves an entity that has been granted access to CU marks though a sponsorship or other paid arrangement.
TAX LIABILITIES
Student-athletes should be aware that their NIL income would likely be considered taxable income. Student-athletes should consult with an appropriate tax professional about the tax implications of any compensation they earn. Creighton is not responsible for any tax liabilities or other costs student-athletes incur as a result of their choice to engage in NIL activities.
PENALTIES FOR FAILURE TO ADHERE TO POLICIES
In situations where student-athletes fail to adhere to the requirements of this policy, the Athletic Department reserves its right to institute penalties which may include, but not limited to, withholding from practice and/or competition.

Through our partnership with the Heider College of Business and its elite cohort of industry-leading faculty, Creighton student-athletes will receive education and training on topics such as building an effective media presence (e.g. content strategy, carving out a niche, developing a persona), basics concepts in law for entrepreneurs (e.g. contracts, intellectual property, liability), and financial planning (e.g. taxes, saving, investing).
Opendorse
Not only does Opendorse serve as Creighton’s NIL disclosure platform, it also has a wide range of NIL educational content and a full-functioning NIL marketplace. Every student-athlete should create a profile on the platform in order to access deals and on-demand NIL education by topic.
NCAA On-Line NIL Education Resource Center
The NCAA has worked with industry experts to create NIL educational programming designed to meet the needs of today’s student-athletes. Everyone is able to access this programming on the NCAA’s website at ncaa.org. This content will regularly be updated and the content will grow and change over time.
Student-Athlete NIL (SANIL)
SANIL helps connect student-athletes to NIL opportunities through an organization named Pride of Omaha.
International Student-Athletes
To protect against any immigration issues, international student-athletes should confer with Creighton’s Global Engagement Office to understand what their student visas permit regarding name, image and likeness before entering into any NIL agreement or activity.
