On July 1, 2021, the NCAA adopted an interim policy that gives student-athletes the opportunity to benefit from their name, image and likeness (“NIL”). This interim policy requires member institutions to follow their own state laws or create their own policies if no state laws have been enacted. This deregulated area, which was previously governed largely by NCAA Bylaw 12.5 “promotional activity” legislation, will likely be in place until student-athlete NIL activity is addressed through nationally applicable federal law or NCAA legislation.
Creighton University strongly supports student-athletes pursuing NIL activities in alignment with both the NCAA interim policy and the Creighton NIL policy. NIL activity includes any activity in which a student-athlete’s NIL is used for endorsement or promotional purposes, including use by the individual student-athlete, an individual other than the student-athlete, a commercial entity or a nonprofit or charitable entity.
It's now easier than ever for Creighton supporters to pitch student-athletes a deal in just a few clicks. After receiving a notification of a deal on the marketplace, an athlete can choose to accept, complete and receive payment for the opportunity all on Opendorse's secure platform. Once a deal is completed, the activity is automatically disclosed for compliance purposes and tax documentation is automatically generated. Former Creighton athletes can also be accessed through the marketplace.
The Opendorse-powered marketplace will maximize NIL support for student-athletes and promises to mobilize the Creighton fan base and local organizations to best support its student-athletes. Opendorse tested six school-specific NIL marketplaces in the spring, and student-athletes at those institutions experienced a 193% increase in NIL opportunities in the first month after the marketplace's launch.
